This document is published and shall be construed in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of www.rub-le.in 

Introduction

www.rub-le.in website ("www.rub-le.in") is an Internet based content and e-commerce portal. Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the Website from time to time. Www.rub-le.in at its sole discretion reserves the right not to accept a User from registering on the Website without assigning any reason thereof.

Services Offered

www.rub-le.in provides Internet-based services through the Web Site. One such service enables users to purchase original products such as home furnishing and furniture, designed and manufactured by one of the trusted furniture manufacturers from Kerala. Upon placing an order, www.rub-le.in shall ship the product to you and be entitled to its payment for the services.

User Account, Password, and Security

You will receive a password and account designation upon completing the Website's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify www.rub-le.in of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you sign out from your account at the end of each session. www.rub-le.in will not be liable for any loss or damage arising from your failure to comply with this Section 2.

Content Posted on Site

You are responsible for any notes, messages, e-mails, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files or other materials or information posted or transmitted to www.rub-le.in and websites managed, operated or licensed by ho. The Sites include rub-le.in. www.rub-le.in will be the worldwide and perpetual owner of all Content. www.rub-le.in shall be entitled to, consistent with our Privacy Policy, use the Content or any of its elements for any type of use forever, including but not limited to, promotional and advertising purposes, and in any media whether now known or existing or hereafter devised, including the creation of derivative works that may include Content you provide. You agree that the Content may be used by www.rub-le.in, consistent with our Privacy Policy and Rules of Conduct on Site, and you are not entitled to any payment or other compensation for such use.

Rules of Conduct on Site:
  1. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
  2. www.rub-le.in may review, edit, reject, refuse to post and/or delete any Content. www.rub-le.in may also review, edit, reject, refuse to post and/or delete Content that violates the Terms or which might be offensive, illegal or that might violate the rights, or harm or threaten the safety of another person.
  3. Any information provided by you shall not be misleading in any way.
  4. You may not post or transmit Content, (even if made in a joking, sarcastic or unintended manner), if it in any way:
    •  Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
    • Is offensive; such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
    • Involves transmission of "junk mail," "chain letters”, or unsolicited mass mailing or "spamming";
    • Infringes upon or violates any third party's rights [including but not limited to, intellectual property rights, rights of privacy (including without limitation, unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];
    • Harasses or advocates harassment of another 
    • Promotes an illegal or unauthorized copy of another person's copyrighted work (see "Copyright complaint" below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
    • Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
    • Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
    • Contains videos, photographs, or images of another person of (a) age 18 or older without his or her express written consent and permission, or (b) those of any minor (regardless of whether you have consent from the minor or his or her legal guardian).
    • Engages in commercial activities and/or sales without rub-le’s prior written consent; such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of "virtual" items related to the Sites. Throughout these terms, www.rub-le.in's "prior written consent" means a communication coming from www.rub-le.in's legal department, specifically in response to your request, and specifically addressing the activity or conduct for which you seek authorization;
    • Interferes with another user's use and enjoyment of the Sites or any other individual's use and enjoyment of similar services; or
    • Refers to any website or URL that, in the sole discretion ofwww.rub-le.in, contains material that is inappropriate for the Sites, contains content that would be prohibited on the Sites, or violates the letter or spirit of these Terms of Use.
You must use the Sites in a manner consistent with any and all applicable laws and regulations. Illegal and/or unauthorized uses of the Sites, including without limitation, collecting usernames and/or email addresses and/or other information of registered members by electronic or other means for any purpose including sending unsolicited email and unauthorized framing of or linking to the Sites, are not permitted. This includes the unauthorized interception of the data stream coming from or going into the Sites, as well as attempting to gain unauthorized access to the Sites or exceeding your authorized access.
You may not engage in advertising to, or solicitation of, other users through the Sites to buy or sell any products or services, including, but not limited to, products or services related to the Sites. You may not transmit any chain letters or unsolicited commercial or junk email to other users via the Sites. It is also a violation of these Terms to use any information obtained from the Sites in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person outside of the Sites without their prior explicit consent. In order to protect our users from such advertising or solicitation, www.rub-le.in reserves the right to restrict the number of messages or emails which a user may send to other users in any defined period to a number which www.rub-le.in deems appropriate in its sole discretion.
You understand that www.rub-le.in has the right at all times to disclose any information (including the identity of the persons providing information or materials on the Sites) as necessary to satisfy any law, regulation or governmental request. This may include, without limitation, disclosure of the information in connection with investigation of alleged illegal activity or solicitation of illegal activity or in response to a lawful court order or subpoena. In addition, we can (and you hereby expressly authorize us to) disclose any information about you to law enforcement or other government officials, as we, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.
www.rub-le.in shall have the right to remove or edit any Content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms or is otherwise inappropriate. Notwithstanding this right of www.rub-le.in, you remain solely responsible for the content of the materials you post in the public areas of the sites and in your private messages. Please be advised that Content posted in public areas of the Sites does not necessarily reflect the views of www.rub-le.in. In no event shall homle.in assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Sites. You hereby represent and warrant that you have all necessary rights in and to all Content you provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libellous, tortuous, or otherwise unlawful information.
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Sites, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. homle.in shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Sites.
It is possible that other users (including unauthorized users or "hackers") may post or transmit offensive or obscene materials on the Sites and that you may be exposed to such offensive or obscene materials. We do not sell or rent personal information (for more information, please refer to our Privacy Policy), however, please carefully select the type of information that you disclose or share with others on the Sites. homle.in will not be responsible if others obtain personal information about you by any means due to your use of the Sites, and use such information to harass or injure you. www.rub-le.in does not approve of unauthorized uses, but by using the Sites you acknowledge and agree that homle.in is not responsible for the use of any personal information. 
Your Account

You agree that any use on the Sites is at your own risk and www.rub-le.in is not responsible for it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Products sold on www.rub-le.in are not for people below age 18, however any products available for children below age 18, can be bought by adults.

Privacy

Use of the Site is governed by our Privacy Policy, which can be located at privacy policy.

User should follow this rules

You agree and undertake to use the Website and the Service only to post and upload messages and material that are proper. By way of example, and not as a limitation, you agree and undertake that when using a Service, you will not:

  1. never harass or abuse the other users in the website 
  2. publishing, distributing and copying the content of the website is strictly prohibited.
  3. upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents;

You further warrant that to your knowledge, no action, suit, proceeding, or investigation has been instituted or threatened relating to any content, including trademark, trade name service mark, and copyright formerly or currently used by you in connection with the Services rendered by www.rub-le.in.

Every effort is made to ensure that the contents on this website is accurate, the website is provided "as is" and www.rub-le.in makes no representations or warranties in relation to the accuracy or completeness of the information found on it. While the content on this site is provided in good faith, we do not warrant that the information will be kept up to date, be true and not misleading or that the site will always (or ever) be available for use.

We do not warrant that the servers that make this website available will be error, virus and bug free and you can accept that it is your responsibility to make adequate provision for protection against such threats. We recommend scanning any files before downloading.

The sites may contain links to other websites ("Linked Sites"). www.rub-le.in is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. homle.in is providing these links to you only as a reference, The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

Pricing/Typographical error

Prices for products are described on our Website and are incorporated into these Terms by reference. All prices are in Indian rupees. Pricing on the product is as it shows, however due to any technical issue, typographical error or product information received from our suppliers' prices of the product may vary. homle.in will try to be accurate, however, if you come across any difference in pricing on the Sites pre and post orders, we request you to contact us within 72 (Seventy Two) hours of placing your order. Www.rub-le.in shall then refund the difference amount within 10-15 business days of intimation. The mode of refund will be the same as at the time of placing the order. Cash on Delivery order refunds will be done by Cheque. If www.rub-le.in comes across any such difference in pricing, it has all the rights to rectify the same or cancel the order. If you have paid a lower amount, www.rub-le.in may request you to pay the difference.

What we do about mispricings

Despite our best efforts, a small number of the many hundreds of items in our catalogue are mispriced. However, we verify prices as part of our dispatch procedures.

If an item's correct price is lower than our stated price, we charge the lower amount and send you the item.

If a product's correct price is higher than our stated price, we will cancel your order and notify you of that cancellation.

Shipping/Risk of loss

All items purchased on the Sites are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery by the carrier.

Product Description

www.rub-le.in tries to be as accurate as possible. However, www.rub-le.in does not warrant that product description or other content on this site is accurate, complete, reliable, current, or error-free. If a product offered by www.rub-le.in itself is not as described, your sole remedy is to return it in unused condition.

Termination  

We may suspend or terminate your use of the Website or any Service if it believes that you have violated any of the Terms. If you or www.rub-le.in terminates your use of the Website or any Service, we may delete any content or other materials relating to your use of the Service and www.rub-le.in will have no liability to you or any third party for doing so.

You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever. Further, you shall be entitled to your royalty payments as per the User License Agreement that has or is legally deemed accrued to you.

Governing Law

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at kerala.

The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of the Terms or the right to use the Website by you contained herein or any other section or pages of the Website or any Linked Sites in any manner whatsoever.

Report Abuse

As per these Terms, users are solely responsible for every material or content uploaded on to the Website. www.rub-le.in does not review the contents in any way before they appear on the Website. www.rub-le.in does not verify, endorse or otherwise vouch for the contents of any user or any content generally posted or uploaded on to the Website. Users can be held legally liable for their contents and may be held legally accountable if their contents or material include, for example, defamatory comments or material protected by copyright, trademark, etc. If you come across any abuse or violation of these Terms, please report to care@rub-le.in or +91 90724 05555.

Copyright and Restriction

Except as otherwise explicitly stated, the Sites are controlled and operated by www.rub-le.in. All material on the Sites, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. Material on the Sites owned, operated, licensed or controlled by us is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means and whether directly or indirectly, and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. It is the customer's responsibility to login earlier if they want to avail better products or styles because the desired product may be available for limited duration.

Miscellaneous. www.rub-le.in may modify the terms herein contained at any time. Such modifications shall be communicated by email and shall be binding on you.

www.rub-le.in’s opinion on all issues pertaining to the interpretation of these Terms shall be final and binding on you. www.rub-le.in is subject to existing laws and legal process and nothing contained in these Terms is in derogation of www.rub-le.in's right and obligation to comply with the Law or governmental, court and requests of enforcement agencies. 

You may not assign any rights or obligations against homle.in without www.rub-le.in’s prior written consent. Www.rub-le.in reserves the right to transfer any right or obligation against you upon notice to you. Upon such assignment, the assignee shall be bound by the Terms in the same manner as www.rub-le.in and www.rub-le.in shall cease to have any liability to you. Www.rub-le.in shall not be responsible for any delay or deficiency due to any force majeure events such natural disasters, acts of terrorism, civil labour strife, labour and transportation strikes.

Change

www.rub-le.in reserves the right, at its sole discretion, to modify or replace the terms at any time. If the alterations constitute a material change to the terms, homle.in will notify you by posting an announcement on the site. What constitutes a material change will be determined at www.rub-le.in’s sole discretion. You shall be responsible for reviewing and becoming familiar with any such modifications. Using any service or viewing any content following notification of a material change to the terms shall constitute your acceptance of the Terms as modified.
